Permit to Kindle a Fire

According to RSA 227-L:17(II), the State of New Hampshire requires all persons to obtain a Permit to Kindle a Fire” prior to any outside burning including brush fires, cooking fires, and seasonal camp fires.  A permit to kindle a fire is also required for chimineas and other portable pottery or metal fireplaces.  You must be at least 18 years of age to obtain a fire permit and you must be the property owner or have written permission from the property owner to kindle a fire.  The Forest Fire Warden or Issuing Agent will advise you of the rules and laws and fire class day conditions. 

The New Hampshire Division of Forests and Lands Forest Protection Bureau maintains a comprehensive website that details forestry laws and also posts the current fire class day, along with fire weather and information on the forest fire classification system. 

Plywood, cardboard, furniture, or any other painted, stained or pressure treated material may not be burned.  For more detailed information on the burning of prohibited materials contact the New Hampshire Department of Environmental Services at 271-1987 or 1-800-498-6868.   A copy of the brochure “State Law Prohibits Residential Trash Burning – What Every Homeowner Should Know” (pertaining to RSA 125-N) can be found on their website.

Any person violating the permit law and its provisions and any person who willfully or recklessly kindles a fire that endangers woodlands, shall be guilty of a misdemeanor punishable by a fine up to $2,000 and/or up to one year in jail.
